Terms & Conditions.
The agreement between you and MComm Technologies for using our hosting, servers and cloud infrastructure. Last reviewed 25 June 2026.

1. Scope of these Terms
These Terms & Conditions ("Terms") govern your use of hosting, virtual server, dedicated server, colocation and cloud services ("Services") provided by MComm Technologies (Pty) Ltd ("MComm", "we", "us", "our"). By activating a service, signing an order form, or accessing the client portal, you ("the Customer") agree to be bound by these Terms.
2. Services we provide
MComm provides web hosting, virtual machines, container platforms, dedicated servers, colocation, cloud backup and managed infrastructure services as described on the relevant product pages (Web Hosting, Cloud Hosting, Servers) and in your signed order form or quote. Service-specific terms — including resource limits, support levels and SLAs — are set out in the relevant product documentation.
3. Your account & access
3.1 Eligibility
You must be 18 years or older and authorised to enter into this agreement on behalf of your organisation.
3.2 Credentials
You are responsible for keeping your client portal credentials, SSH keys, API tokens and control panel passwords secure. MComm will never ask for your password.
3.3 Authorised users
You are responsible for all activity that occurs under your account, including actions taken by employees, contractors or third parties you have granted access to.
4. Acceptable Use Policy
You agree not to use the Services to:
- Transmit bulk unsolicited email ("spam") or run open mail relays;
- Host, distribute or link to content that infringes intellectual property rights, or that is unlawful under South African law;
- Run port scans, brute-force attacks, or other malicious activity against other networks;
- Host cryptocurrency miners, malware, phishing kits or command-and-control infrastructure;
- Engage in activity that, in MComm's reasonable opinion, threatens the stability or security of our shared infrastructure.
MComm may investigate suspected violations and, where warranted, suspend affected services without prior notice.
5. Service levels & uptime
MComm designs its infrastructure for high availability. Specific uptime targets (where applicable) are stated in your product SLA. Scheduled maintenance windows will be communicated at least 48 hours in advance wherever possible. Service credits for SLA breaches, where applicable, are the Customer's sole and exclusive remedy for downtime.
6. Fees, billing & cancellation
6.1 Fees
Fees are quoted in South African Rand, exclusive of VAT, and are payable monthly in advance unless otherwise agreed in writing.
6.2 Late payment
Overdue invoices may attract interest at the prevailing prime rate plus 2%, and may result in suspension of services after 7 days' written notice.
6.3 Cancellation
You may cancel any monthly service at the end of the current billing cycle by giving at least 30 days' written notice. Annual contracts are non-cancellable except as provided for in your signed order form.
7. Your data & backups
You retain all intellectual property rights in data you upload to our Services. We act as a processor on your behalf. Automated backups are provided as a recovery convenience; you remain responsible for maintaining your own off-site copies of critical data.
8. Liability & indemnities
To the maximum extent permitted by law, MComm's aggregate liability under these Terms is limited to the fees paid by the Customer for the affected service in the 12 months preceding the event giving rise to liability. Neither party is liable for indirect, consequential or punitive damages.
9. Suspension & termination
MComm may suspend or terminate Services if the Customer breaches these Terms, fails to pay undisputed invoices, or uses the Services in a manner that creates a security or operational risk. Where reasonable, MComm will provide advance notice and an opportunity to cure.
10. Governing law
These Terms are governed by the laws of the Republic of South Africa. The parties submit to the exclusive jurisdiction of the South African courts.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via the client portal or by email at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance.
